Resolution of the County of Allegheny, Commonwealth of Pennsylvania, transferring all power of the Office of the Jury Commission to the Court of Common Pleas, and reducing the salaries of the Jury Commissioner.

The Council of the County of Allegheny hereby resolves as follows:

 

WHEREAS, Allegheny County is exploring options that will allow for the reduction of Row Offices; and

 

WHEREAS, the Jury Commission Office has been universally accepted as an office that promulgates such change and has been the subject of recent internal change by the Court of Common Pleas of Allegheny County regarding duties of power; and

 

WHEREAS, it is in the best interest for the taxpayers of Allegheny County to provide a measure of tax relief concerning the impending change and elimination of said office; 

 

NOW, THEREFORE, BE IT RESOLVED:

 

SECTION 1.

 

Allegheny County Council does hereby transfer all power of the office of the Jury Commission to the Court of Common Pleas. The two elected Jury Commissioners, as duly elected officials shall still continue in their administrative rule, under the Court of Common Pleas jurisdiction.

 

SECTION 2.

 

As an act of cutting cost to the citizenry of Allegheny County and as a precursor to Row Office Reform, it is hereby enacted that the two elected Jury Commissioners shall have their salaries legally reduced under State Law to $26,000 per year to be enacted by January 1, 2005 and the office shall cease to exist in its current form by the time table established by the Court of Common Pleas by the end of 2005 for the office as a whole.

 

SECTION                     3.                     If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.

 

SECTION                     4.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
