TITLE
An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Ordinance No. 06-04-OR, enacted March 22, 2004, entitled “An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, establishing facility and recreation rates and fees for the use of County recreational and park facilities effective April 1, 2004,” by providing that facilities are available to non-profit groups at the reduced rental rate of 50% and ball field permits available to groups under 18 years of age, free of charge, between the hours of 9:00 a.m. and 9:00 p.m. Monday through Friday, and 9:00 a.m. and 12:00 p.m. Saturdays and Sundays.
BODY
Whereas, a 50% fee reduction for rental of park facilities is offered to non-profit organizations that
provide the County with satisfactory 501(c)3 tax exempt documentation and/or non-profit classification
status documentation.
Whereas, the rate for the permitting of a ball field is $30.00 for a three hour time slot;
Whereas, an exception from the permitting fee has been crafted for groups under 18 years of age, but that exception only applies to ball fields;
Whereas, the current exception to ball field permits for groups under 18 years of age is between the hours of 12:00 p.m. and 9:00 p.m. Saturday and Sunday, when fields are popular to park users and open to the public for rental at $30.00 per three hour time slot;
Whereas, this policy should be applied uniformly to all ball fields.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. Permit Reservation Fees.
Exhibit A, Page 10, “Permit Reservation Fees” is amended to read as follows:
A 50% fee reduction for rental of park facilities is offered to non-profit organizations that provide the County with satisfactory 501(c)3 tax exempt documentation and/or non-profit classification status documentation.
SECTION 3. Ball fields.
Exhibit A, Page 17, “Ball fields” is amended to read as follows:

Ball field Permits for groups under 18 years of age FREE OF CHARGE
9:00 a.m. - 9:00 p.m.
Monday through Friday
9:00 a.m. - 12:00 p.m.
Saturday and Sunday
Ball fields: 30.00/3 hr. time slot
*Any additional cost realized by the County is to be reimbursed by user subject to approval for the 2004 calendar year.
SECTION 4. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 5. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
