An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the Oliver Miller Homestead Associates to continue to use a certain portion of the County’s South Park for operation of the historical property known as the Oliver Miller Homestead.

Whereas, since on or about September 23, 1976, Oliver Miller Homestead Associates, with the permission from the County, have established and maintained the Oliver Miller Homestead stone farmhouse as a public museum commemorating pioneer settlers of Western Pennsylvania; and
Whereas, the County deems it in the public interest to authorize the Oliver Miller Homestead Associates to continue to conduct tours, historical re-enactments, and educational activities at the Oliver Miller Homestead venue in South Park; and
Whereas, Article IV, Section 2(k) of the Allegheny County Home Rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real estate property.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.
The provisions set forth in the Preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
SECTION 2. Authorization of the Continued Use of County Real Property.
A. Allegheny County Council hereby approves the continued use of real property located off Stone Manse Drive in the County’s South Park by Oliver Miller Homestead Associates for operation of an historical landmark known as the Oliver Miller Homestead to conduct tours, perform re-enactments, and administer educational activities.
B. The term of this authorization begins upon Council approval and continues through December 31, 2024. At the County’s discretion, this authorization may be extended for two additional years.
C. The proper officers of the County are hereby authorized to execute any and all documents necessary to effectuate the authorization granted by this legislation.
SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 4. Repealer. Any Resolution and Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same effects this Ordinance.
