Title
An Ordinance amending and supplementing the Allegheny County Code of Ordinances, Division 5, entitled "Health and Sanitation," through the creation of a new Chapter 575, entitled "Restaurant Inspection Reporting," in order to provide a means of keeping the County's residents apprised of the results of Health Department inspections of restaurants located within Allegheny County.

WHEREAS, the Allegheny County Health Department periodically inspects restaurants operating within the County in order to safeguard the health and safety of individuals consuming food in such restaurants; and
WHEREAS, although the Department maintains a website that describes the location and permissibility of smoking in each restaurant, no information is included regarding the restaurants' inspection results, and it does not appear that the "Consumer Alert" section of the Department's Food Safety website has been updated since January of 2008; and
WHEREAS, it is the judgment of Council that providing current and up to date information regarding inspection results and remedial actions taken by the restaurants will greatly enhance the value of the Department's inspection process, while simultaneously increasing the public's confidence in the safety of the restaurants within the County;
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1.
The Allegheny County Code of Ordinances, Division 5, entitled "Health and Sanitation," is hereby amended through the creation of a new Chapter 575, entitled "Restaurant Inspection Reporting," and comprised as follows:

RESTAURANT INSPECTION REPORTING
§575-1. General Reporting Requirement.
The results of all inspections of any food facility subject to inspection under the Allegheny County Health Department's Food Safety program shall be posted to the Department's website no later than thirty (30) days after the inspection is performed. Such posting shall be made both to the Department's Food Safety Program website and to any portion of the Department's website describing the location of and/or permissibility of smoking in any food facility located within Allegheny County.
§575-2. Remedial Action Reporting.
In the event that safety issues are identified as a result of any inspection of any food facility, all remedial action(s) undertaken by the food facility in question shall be reported by the Allegheny County Health Department immediately upon confirmation of the remedial action(s) taken. Such reporting shall be posted both to the Department's Food Safety Program website and to any portion of the Department's website describing the location of and/or permissibility of smoking in any food facility located within Allegheny County.
SECTION 2. Severability.
If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
