An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the use of County Land by the Northern Allegheny County Senior Softball League for the sponsorship of the senior softball league in NORTH PARK.

Whereas, the County has authorized use of the softball fields in North Park to be used by the Northern Allegheny County Senior Softball League in NORTH PARK for many years.
Whereas, Northern Allegheny Senior Softball League had held many games and sponsored may leagues for competition and the County wishes to continue this practice under a three year contract, effective November 20, 2007 through November 20, 2010.
Whereas, by permitting this use, the County enjoys improved public use of park fields.
Whereas, Article IV, Sections 2.k. of the Allegheny County Home Rule Charter vests the County's Council with the power and duty by ordinance to permit the use of County land, buildings or other real or personal property owned by the County.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble
The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
SECTION 2. Authorization of a lease for the use of County Real Property
A. County Council does hereby authorize the Allegheny County Parks Department on behalf of Allegheny County to permit Northern Allegheny County Senior Softball League to use the ball fields in North Park known as Lambert #1 and Mashuda #2 in accordance with the agreement negotiated between Allegheny County and the Northern Allegheny County Senior Softball League.
SECTION 3. The County Manager or his designee is authorized to take any and all further action necessary or proper to carry out the purpose of this Ordinance.
SECTION 4. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
SECTION 5. Repealer. Any prior Resolutions or Ordinances or part thereof conflicting with the provisions of this Ordinance are hereby repealed insofar as the same affects this Ordinance.
