An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania authorizing the County Controller and Division of Purchasing and Supplies to conduct an Internet auction of the contents of the County Warehouse and former Coroner and Crime Lab equipment and furniture.

Whereas, the County purchased various equipment and furniture over the years that is no longer needed.
Whereas, Section 5 - 701.05 of the Administrative Code generally provides for the sale or disposition of County property, other than real estate, either by public or private sale; and
Whereas, the County Controller and the Division of Purchasing believe that the most efficient and effective method of disposal of this surplus equipment and furniture is by public sale to the highest bidder(s) at an auction using the Internet; and
Whereas, Article IV, Section 2(k) of the Allegheny County Home Rule Charter vests County Council with the power and duty to authorize by ordinance the conveyance of County land, buildings or other real and personal property; and
Whereas, County Council finds that the use of the Internet to conduct a public auction of any and all referenced surplus equipment and furniture is an appropriate and efficient method of disposing of these items.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.
The provisions set forth in the Preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. Authorization to Sell Surplus County Equipment and Furniture by an Internet Auction.
A. The Allegheny County Controller is hereby authorized to conduct a Public Auction using the Internet of the following items of surplus County property:
equipment, furniture and contents of the County Warehouse, Morgue and Crime Lab, to the extent that such property is specifically delineated in Attachment A to this Ordinance.
B. The public auction of the above-named item shall be conducted at such a time and under such terms and conditions as shall be established by the Controller and Purchasing Division.
C. Following the receipt of final bids, the County Controller is authorized to sell the surplus equipment and furniture to the highest bidder(s).
SECTION 3. Additional Actions Authorized.
County Controller and the County Manager are hereby authorized to take any other additional actions deemed necessary and prudent to carry out the intentions of the Ordinance.
SECTION 4. Severability. If any provision of the Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall continue in full force and effect.
SECTION 5. Repealer. Any ordinance or any part of an Ordinance conflicting with the provisions of this Ordinance is hereby repealed to the extent of such conflict.
