Motion of the Council of Allegheny County authorizing the settlement of the pending action against the Council of Allegheny County (“Council”) and Allegheny County (“County”) in the United States District Court for the Western District of Pennsylvania, styled Buka v. Allegheny County, Pennsylvania and Office of County Council, Allegheny County, C.A. No. 2:20-cv-00669 (“Litigation”).

WHEREAS, Stephanie Buka (“Plaintiff”) filed the above-referenced suit against Council and County, alleging discrimination in violation of the Americans with Disabilities Act, as amended, 42 U.S.C. § 12101 et seq.; Title VII, 42 U.S.C. §§ 2000e, et seq.; and the Pennsylvania Human Relations Act, 43 P.S. §§ 951, et seq.;
WHEREAS, the County and Council denied and continue to deny and dispute the Plaintiff’s allegations in the Litigation;
WHEREAS, the County and Council, by entering into this Agreement to settle disputed claims, admit no liability whatsoever;
WHEREAS, the Council desires to avoid further expense, inconvenience and distraction of litigation, and to put to rest all further controversy related thereto, to compromise the disputed claims and differences that were or could have been raised in the Litigation, and to effect the release of all such claims in the Litigation, upon the terms and conditions set forth hereafter;
WHEREAS, without admission of liability on the part of Council or County, Plaintiff has agreed to waive and release all claims against the Council and the County, in exchange for payment from Council in a gross amount not to exceed One Hundred Thousand Dollars ($100,000.00), and such other terms and conditions as shall be described in the Agreement; and
NOW THEREFORE, IT IS HEREBY MOVED BY THE COUNCIL OF ALLEGHENY COUNTY,
That this Council hereby authorizes The President of Council to enter into a settlement agreement with Plaintiff in a form approved by the Solicitor to Council, with terms consistent with this Motion, and in an amount not to exceed One Hundred Thousand Dollars ($100,000).
