TITLE
Ordinance deleting Section 6 of Ordinance No. 13-02, passed in Council on April 2, 2002, entitled, “An Ordinance amending Ordinance No. 78, approved November 27, 2001, entitled, “An Ordinance providing for the establishment of the tax levy upon all real property subject to taxation within the limits of Allegheny County for calendar year 2002”, by reducing the levy of taxes on all real property subject to taxation within the limits of Allegheny County from 4.72 mills to 4.69 mills”, and repealing Ordinance No. 35-02, passed in Council on July 16, 2002, entitled, “An Ordinance amending Section 6 of Ordinance No. 13-02, passed in Council on April 2, 2002, which reduced the levy of taxes on all real property subject to taxation within the limits of Allegheny County from 4.72 mills to 4.69 mills, by modifying certain provisions of the refund policy.”

The Council of the County of Allegheny hereby enacts as follows:
Section 1. Section 6 of Ordinance No. 13-02, as amended by Ordinance No. 35-02, which currently reads:
If the revenues that are collected in 2002 and 2003 using the 2002 certified assessments for taxation purposes, after all refunds or rebates are made, result in revenue receipts in excess of the amount of real estate tax revenue budgeted for 2002 as determined by the independent certified audit, the excess will be returned to the taxpayer in the form of a refund or credit to future year tax payments.

Section 2.
Ordinance No. 35-02, passed in Council on July 16, 2002, entitled, “An Ordinance amending Section 6 of Ordinance No. 13-02, passed in Council on April 2, 2002, which reduced the levy of taxes on all real property subject to taxation within the limits of Allegheny County from 4.72 mills to 4.69 mills, by modifying certain provisions of the refund policy.”, is hereby repealed.
SECTION 3. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 4. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
