An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the County’s acceptance of the donation of two (2) MSA Altair 5x MultiGas Detectors.

                     Whereas, MSA Safety Incorporated (“MSA”) has offered to donate two (2) MSA Altair 5x MultiGas Detectors (the “Gas Detectors”) to the County for use by the Allegheny County Emergency Services Fire Academy and by Allegheny County Emergency Services; and

 

                     Whereas, the Allegheny County Emergency Services Fire Academy and Allegheny County Emergency Services wish to accept the aforesaid donation of the Gas Detectors for the following purposes: the training firefighters and hazardous materials first responders to determine the level of respiratory protection that must be taken to prevent injury or illness when entering hazardous atmospheres and/or to determine the cause of injury or illness of victims founds at a scene; and for the detection of potential hazardous gases in the atmosphere when responding to emergencies in support of the various fire, emergency medical services, hazardous materials teams, or law enforcement agencies in the County; and

 

                     Whereas, Article IV, Sections 2(j) of the Allegheny County Home Rule Charter vests the County’s Council with the power to accept donations of personal property on behalf of the County.

 

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.                                            Incorporation of Preamble.

 

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

 

SECTION 2.                                          Authorization to Accept Donated Equipment.

 

A.                     County Council does hereby authorize the acceptance of MSA’s donation of two (2) Gas Detectors.

 

B.                     The donated Gas Detectors shall be used by the Allegheny County Emergency Services Fire Academy for training firefighters and hazardous materials first responders to determine the level of respiratory protection that must be taken to prevent injury or illness when entering hazardous atmospheres and/or to determine the cause of injury or illness of victims founds at a scene and by the Allegheny County Emergency Services when responding to emergencies in support of the various fire, emergency medical services, hazardous materials teams, or law enforcement agencies in the County to detect potential hazardous gases in the atmosphere.

 

C.                     The appropriate County officers and officials are authorized to take such action as is necessary to carry out the purposes of the authorization granted herein.

 

 

SECTION 3.                                          SeverabilityIf any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.

 

 

SECTION 4.                                          RepealerAny Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.

 

 

SECTION 5.                                          Effective Date. This Ordinance shall become effective immediately.
