TITLE
An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of a donation of real property from the Western Pennsylvania Conservancy.

BODY
Whereas, the Western Pennsylvania Conservancy, “WPC” has available certain funding designed to purchase and donate real property for public purpose and enhance the County Parks; and

Whereas, the WPC has offered to donate a 64.7 acre parcel of real property to the County; and

Whereas, the County's Department of Parks has recommended acceptance of said proposed real property; and

Whereas, Article IV, Sections 2.j. of the Allegheny County Home Rule Charter vests the County Council with the power to accept real property on behalf of the County.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

Section 2. Acceptance of a Donation of Real Property

County Council does hereby authorize the Allegheny County Parks Department on behalf of Allegheny County to accept the donation of a tract of land totaling 64.7 acres in Hampton Township, Allegheny County from Western Pennsylvania Conservancy to become part of Allegheny County North Park.

Section 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
Section 4. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
