An Ordinance authorizing the County of Allegheny to grant a revocable license to Duquesne Light Company to replace its North-Wildwood electric power line in the southeast section of North Park.

Whereas, the County Council of Allegheny County deems it advisable to authorize a revocable license to Duquesne Light Company, and receive compensation in the amount of $60,000.00 for use of County Property, for replacing approximately 3,420 feet of its existing power line, located in the southeast section of North Park, from Shady Oak Circle Drive, along the north side of Wildwood Country Club property and over Hemlock Road to the old park boundary line with property formerly of Vincent P. Rutledge, in Hampton Township, with its North-Wildwood Z103 138kV Line, the location of which is depicted on the drawing that is attached hereto as Exhibit A and incorporated herein by reference (the “License Area”); and

Whereas, the County Council of Allegheny County also deems it advisable for Duquesne Light Company to replace a portion of its existing power line with the new North-Wildwood Z103 138 kV Line over an existing easement on County property, formerly of Vincent P. Rutledge, acquired from Western Pennsylvania Conservancy by deed recorded March 14, 2007; and

Whereas, in accordance with Section 701.02 E of the County Administrative Code, the County Manager has authorization to enter into a Revocable License Agreement.

The Council of the County of Allegheny hereby enacts as follows:

Section 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

Section 2. Authorization to enter into a Revocable License Agreement and terminate any License Agreement rendered useless.
