The Council of the County of Allegheny hereby enacts as follows:

Section 1.

The Allegheny County Board of Elections is directed to place the following question on the 2005 Municipal Primary Ballot:

Shall Allegheny County's Home Rule Charter be amended to a) combine the elected Recorder of Deeds and Register of Wills offices into an elected Recorder of Wills & Deeds office; b) combine the elected Prothonotary and Clerk of Courts offices into an elected Clerk of Courts office; and, c) eliminate the elected Jury Commissioners (2) offices and assign said responsibilities to the Court of Common Pleas, Allegheny County?

Section 2.

Upon approval of the above question, Allegheny County's Home Rule Charter shall be amended to read as follows:

Article III, Section 3 - The elected officers of the County shall be 15 County Council Members, the Chief Executive, Sheriff, District Attorney, Controller, Treasurer, and Coroner. The offices and positions of the independently-elected Recorder of Deeds and Register of Wills are hereby abolished upon the election of the Recorder of Wills & Deeds. The offices and positions of the independently-elected Prothonotary and Clerk of Courts are hereby abolished upon the election of the newly-created Clerk of Courts. The office and position of the independently-elected elected Jury Commissioners (2) is hereby abolished upon the assignment of said responsibilities to the Court of Common Pleas, Allegheny County.

SECTION 3. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of t...
