Whereas, The Pennsylvania Turnpike Commission are in need of obtaining the use of approximately six acres of property in NORTH PARK for the construction of a wetland mitigation site.

Whereas, The Department of Parks has recommended the approval of said property; and

Whereas, Article IV, Section 2.k of the Allegheny County Home Rule Charter vests the County's Council with the power to authorize the lease of real property on behalf of the County.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble

The provisions set forth in the preamble of this Ordinance are incorporated by reference as set forth in their entirely herein.

SECTION 2. Authorization of Use of County Property

County Council does hereby authorize the Allegheny County Parks Department on behalf of Allegheny County to lease approximately six acres of property located in NORTH PARK to the Pennsylvania Turnpike Commission for a period of five years for the construction of the wetland mitigation site. No lease payments are due the County.

Pennsylvania Turnpike Commission will monitor and maintain the mitigation Site for a period of five years or until such time that the Mitigation Site is deemed successful; the County agrees to retain ownership and will preserve the Mitigation Site as a wetland.

SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
