TITLE

An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the use of County property by the Harrison Hills Park Council of Friends.

 

BODY

                     Whereas, the Harrison Hills Park Council of Friends are desirous of obtaining the use of one of the Harrison Hills Park's rental home for an Environmental Learning Center; and

 

                     Whereas, the County's Department of Parks has recommended the lease of said real property; and

 

                     Whereas, Allegheny County Council of Friends for the Parks was authorized by Ordinance 54-02 of Allegheny County Council; and

 

                     Whereas, Article IV, Sections 2.k. of the Allegheny County Home Rule Charter vests the County's Council with the power to authorize lease of real property on behalf of the County.

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.                     Incorporation of the Preamble

 

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

 

Section 2.  Authorization of use of County Property

 

                     County Council does hereby authorize the Allegheny County Parks Department on behalf of Allegheny County to lease one Park House located in Harrison Hills Park as an Environmental Learning Center by the Harrison Hills Park Council of Friends through December 31, 2009.  No lease payments are due Allegheny County.

 

Section 3.  Severability.   If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.

 

Section 4. Repealer.   Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
