The Council of the County of Allegheny hereby enacts as follows:

Section 1.

Article 1013, § 1013.09 of the Allegheny County Administrative Code is hereby amended to add a new Subsection R as follows:

R. Certification of Candidate's Eligibility

(1) Any person who is a candidate for Chief Executive, member of Allegheny County Council, or an Independently Elected County Official shall be required to file a certification form with his or her nomination petitions. Such certification shall verify that the candidate is eligible to hold the office for which he or she is running, pursuant to the Constitution of the Commonwealth and related state and county election laws.

i. Certification forms to be filed shall be promulgated by the Division of Elections for dissemination with nomination petitions to candidates for covered offices.

(2) Upon certification of election results, candidates who are certified as winning a covered office must file a second certification form, verifying that he or she is still eligible to hold the office that he or she has won. Such certification shall be filed with the Division of Elections prior to the candidate's swearing-in.

(3) Following submission of either certification, the Division of Elections shall be responsible for verifying that the candidate is eligible to hold the office and, in the event that a candidate is ineligible, must notify the candidate of such ineligibility prior to the deadline for withdrawal of nomination petitions or prior to the candidate's swearing-in.
