An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the County’s acceptance of the donation of a Chlorine Training Housing from Westlake Corporation and a Decontamination Trailer from the Department of Veterans Affairs.

Whereas, Westlake Corporation (“Westlake”) has offered to donate a new Chlorine Training Housing (“CTH”) and the Department of Veterans Affairs (“VA”) has offered to donate a used Decontamination Trailer (“Trailer”) to the County for use at the Allegheny County Emergency Services Fire Academy; and

Whereas, the Allegheny County Emergency Services Fire Academy wishes to accept the donation of the CTH and the Trailer to be used in the Hazardous Materials Response Team training area; and

Whereas, Article IV, Section 1.4-402(j) of the Allegheny County Home Rule Charter vests the County’s Council with the power to accept donations of personal property on behalf of the County.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of Preamble.

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

SECTION 2. Authorization to Accept Donated Equipment.

A. County Council does hereby authorize the acceptance of Westlake’s donation of a CTH and the VA’s donation of a Trailer.

B. The donated CTH and Trailer shall be used by the Allegheny County Emergency Services Fire Academy for Hazardous Materials Response Team training.

C. The appropriate County officers and officials are authorized to take such action as is necessary to carry out the purposes of the authorization granted herein.


SECTION 3. Severability.

If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
