A Resolution of the Council of the County of Allegheny ratifying the Chief Executive's Declaration of Emergency.

Whereas, on September 17, 2004, adverse weather conditions associated with Hurricane Ivan have caused flooding, power outages and public health and safety emergencies on a scale not experienced in Allegheny County for over fifty (50) years; and
Whereas, in order to meet the exigencies of the emergency, Allegheny County Chief Executive Dan Onorato signed a Declaration of Disaster Emergency on September 17, 2004; and
Whereas, pursuant to the Allegheny County Administrative Code, §5-311.06, and the Pennsylvania Emergency Management Code, 35 Pa. C.S. §7501, et seq., County Council must ratify the Chief Executive's Declaration of Disaster Emergency within seven (7) days of said Declaration.
The Council of the County of Allegheny hereby resolves as follows:
Section 1. Incorporation of Preamble.
The provisions set forth in the preamble to this Resolution are incorporated by reference in their entity herein.
Section 2 . Ratification.
The County Council of the County of Allegheny does hereby ratify and adopt the Declaration of Disaster Emergency as signed by the Chief Executive which is attached hereto and marked Exhibit “1”.
Section 3. Termination.
Pursuant to the Allegheny County Administrative Code Section 5-311.06, this Declaration shall expire in thirty (30) days, unless otherwise extended by County Council.
Section 4. Severability. If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.
Section 5. Repealer. Any resolution or ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
