TITLE

An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing acceptance of a donation of 14.14 acres of land located in South Park Township in the County of Allegheny.

 

BODY

Whereas, the Western Pennsylvania Conservancy has offered to donate to the County 14.14 acres of real property located in South Park Township adjacent to the County's South Park, to which the Conservancy owns an unencumbered fee simple absolute title; and

 

Whereas, the County's Department of Parks has recommended acceptance of the proposed donation of real property; and

 

Whereas, Article IV, Sections 2.j. of the Allegheny County Home Rule Charter vests the County's Council with the power to accept donations of real property on behalf of the County.

 

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.                                          Incorporation of the Preamble.

 

The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

 

SECTION 2.                                          Acceptance of 14.14 Acres of Land.

 

County Council does hereby authorize the acceptance of 14.14 acres of real property located in South Park Township, County of Allegheny donated by the Western Pennsylvania Conservancy, to become part of the County's South Park.  The appropriate County officers and officials are authorized to take such action as is necessary to carry out the purposes of the authorization granted herein.

 

SECTION                     3.                     Severability.                        If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION                     4.                     Repealer.   Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
