An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Article 203 of the Administrative Code by providing for a new § 203.06, “Requirement of binding resolution for commitment of County funds.”

WHEREAS, Article 203 § 203.01 recognizes the independent authorities created singularly or jointly by Allegheny County for the performance of important government functions;
WHEREAS, while presumably independent of Allegheny County, said authorities may commit the funds of Allegheny County to match grant funding from the Federal or State government; and
WHEREAS, such commitment of matching funds should not occur without the consent and notice of the legislative and executive branches of County government; and
WHEREAS, such consent and notice is even more imperative due to the County's current fiscal condition.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1.
Article 203, “County Authorities,” of the Administrative Code is hereby amended to add a new § 203.06 as follows:
§ 203.06. Requirement of binding resolution for commitment of County funds.
All singularly or jointly created County Authority listed in § 203.01 shall be required to obtain a binding resolution from the County of Allegheny authorizing the request of, application of, or acceptance of any state or federal funds requiring a County match from the Operating or Capital Budgets of the County of Allegheny prior to any such request, application, or acceptance of funds.
SECTION 2. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 3. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
