Title
An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the short-term use of County owned real property by the Western Pennsylvania Humane Society.

Body
Whereas, Article IV, Section 2(k) of the Allegheny County Home Rule Charter (the “Charter”) vests County Council with the power and duty by ordinance to lease or permit the use of County real property; and

Whereas, proper disposal of electronic waste is necessary to protect our environment; and

Whereas, the Western Pennsylvania Humane Society (“WPHS”) desires to provide free electronic waste disposal for Allegheny County residents at collection sites as a fund raising vehicle; and

Whereas, the County regional parks are a convenient and visible site to accomplish the collection.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.


SECTION 2. Authorization to Enter into Short-Term Leases of County Owned Real Property.

County Council does hereby permit WPHS to use certain County real property, namely, certain County park sites as collection sites by staff and volunteers of the WPHS for the collection of electronic waste items for the purpose of recycling, resale, or proper disposal.


SECTION 3. Severability. If any provision of this Ordinance shall be determined to be
unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.

SECTION 4. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
