An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania directing the County Board of Elections to place on the 2006 November General Election Ballot for the consideration of the County's voters two referendum questions concerning whether the County's Home Rule Charter should be amended to allow Members of County Council to run for nomination or election to another elected office without having to first resign from County Council and to fill vacancies on County Council at the next regularly scheduled primary or November election.

The Council of the County of Allegheny hereby enacts as follows:

Section 1. Referenda on Amendments to Home Rule Charter Authorized.

Pursuant to Sections 2 and 3 of Article XII of the Allegheny County Home Rule Charter, the Board of Elections is hereby directed to place on the ballot for consideration by the County's voters at the 2006 November Election the following questions:

Should Article III, Subsection 6(b) of Allegheny County's Home Rule Charter be deleted in order to allow Members of County Council to run for nomination or election to another elected office, other than that of County Council, without first having to resign from County Council?

Should Article III, Subsection 9 (b) of the Allegheny County Home Rule Charter be amended to provide that vacated Allegheny County Council seats will be filled at the next available primary or November election occurring at least sixty days after the vacancy rather than through an appointment process and that the person elected for the unexpired portion of the vacated term shall take office as soon as possible?


Section 2. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
