Resolution of the County of Allegheny, Commonwealth of Pennsylvania, directing that any revenue received by the County from gaming licensees pursuant to Act 71 of 2004, be utilized for the purpose of either reducing Allegheny County property taxes or reducing Allegheny County debt.

                     WHEREAS, Act 71 of 2004 authorizes racetrack and other gaming in the Commonwealth of Pennsylvania through gaming licensees with oversight by the newly-created Pennsylvania Gaming Control Board; and

 

                     WHEREAS, the legislation provides that Counties of the Second Class receive 2% of the gross terminal revenue to the County hosting the licensed facility from each such licensed facility.

 

The Council of the County of Allegheny hereby resolves as follows:

 

 

SECTION 1.

 

Revenue received by the County from gaming licensees in the County, pursuant to Act 71 of 2004, shall be utilized for the purpose of either reducing Allegheny County property taxes or reducing Allegheny County debt.

 

SECTION                     2.                     If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.

 

SECTION                     3.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
