An Ordinance granting the Allegheny County Economic Development department the authority to enter into a grant agreement with the Pennsylvania Department of Environmental Protection (DEP) in order to receive 75% of the funding ($12,000.00) for a Phase I study updating four separate Act 167 Storm Water Management Plans.

WHEREAS, the Storm Water Management Act 167 passed by the General Assembly in 1978 establishes a systematic program for counties to develop watershed plans that recommend control measures to address storm water runoff from new developments; and
WHEREAS, Section 5 (a) of the Act requires that each watershed plan be reviewed and necessary revisions be made at least every 5 years after its initial adoption by county's within the Commonwealth; and
WHEREAS, DEP regulations require municipalities in “urbanized areas” pursuant to its Municipal Separate Storm Sewer System program (known as “MS4's”) to obtain permits and develop and implement a storm water management program that must be designed to reduce the discharge of pollutants from storm sewers to the maximum extent practicable, with the goal of protecting water quality and satisfying the appropriate water quality requirements of the federal Clean Water Act and the PA Clean Streams Law; and
WHEREAS, eighteen North Hills COG communities have requested the County of Allegheny to undertake the update of the Pine Creek Stormwater Management Plan, the Girtys Run Stormwater Management Plan, the Squaw Run Stormwater Management Plan and the Deer Creek Stormwater Management Plan; and
WHEREAS, by updating these plans the County of Allegheny will be complying with Act 167 (Section 5(a)), and the municipalities will be complying with the DEP's Municipal Separate Storm Sewer System program (MS4's); and
WHEREAS, Article IV Section 2 (j) of the Home Rule Charter of Allegheny County requires that County Council accept grants by ordinance on behalf of the County.
