An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, allowing those property owners whose property value was affected by the flooding of Hurricane Ivan to appeal to change the valuation of their property through April 30, 2005.

                                          WHEREAS, the flooding caused by Hurricane Ivan has affected the valuation of many properties in Allegheny County, and

 

WHEREAS, previous amendments to the Administrative Code set forth the dates and times for appealing the assessment of a piece of property for the years 2004 and 2005, specifically providing that appeals for the years 2004 and 2005 would only be allowed until April 30, 2004;

 

WHEREAS, the flooding caused by Hurricane Ivan changed the value of many properties in Allegheny County, and to correct any possible inequities, and to prevent an improper valuation in 2005 of those properties affected by the flooding, this Ordinance will allow those property owners to pay taxes based on the proper valuation after the flooding, rather than the valuation before; accordingly

 

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.

 

Those property owners whose valuation was affected by the flooding of Hurricane Ivan may appeal their 2005 certified values with the Appeal Board on or before the 30th day of April 2005.

 

SECTION                     2.                     If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION                     3.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
