Ordinance authorizing the County of Allegheny to vacate Chartiers Creek Bridge No. 15 carrying Turner Street over Chartiers Creek between Rosslyn Farms Borough and the 28th Ward of the City of Pittsburgh to the City of Pittsburgh (Project No. CC15-0607).
Body
WHEREAS, the Chartiers Creek Bridge No. 15 (hereinafter called "the bridge") has been closed to traffic for several years and has been scheduled for demolition; and
WHEREAS, the Chartiers Nature Conservancy, a Pennsylvania non-profit corporation, wishes to utilize the bridge in its "Chartiers Creek Trail" for pedestrians and bicycles; and
WHEREAS, the Chartiers Nature Conservancy owns land adjacent to the bridge within the City of Pittsburgh; and
WHEREAS, the Borough of Rosslyn Farms has declined involvement with the bridge; and
WHEREAS, by its Resolution enacted May 23, 2000, recorded in Resolution Book Volume 134 on June 7, 2000, the Council of the City of Pittsburgh authorized to enter into an agreement with the County of Allegheny to accept the vacation of the bridge.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. INCORPORATION OF THE PREAMBLE
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. AUTHORIZATION TO VACATE CHARTIERS CREEK BRIDGE NO. 15 TO THE CITY OF PITTSBURGH
Council deems it advisable and necessary to vacate the bridge to the City of Pittsburgh.
SECTION If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
