An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing an easement and right-of-way to Peoples Natural Gas Company for the up-grading of an existing facility located in South Park on Corrigan Drive.
WHEREAS, Ordinance No. 30-13-OR was originally approved for Equitable Gas on December 17, 2013 through Council Agenda No. 7322-12. In December 2013, Equitable Gas was sold to Peoples Natural Gas Company and could no longer do business under that name. The following proposal is the same as before, incorporating the name change.
WHEREAS, Peoples Natural Gas Company has an existing building on Corrigan Drive in South Park which needs to be enlarged to handle increase customer demands.
WHEREAS, Peoples Natural Gas Company will raze the existing 6’ x 8’ building and replace the structure with a 12’ x 18’ building. Peoples Natural Gas Company will re-grade the property, install a fence of the County’s choice and plant mature trees to block the view from the entrance to the park. Peoples Natural Gas Company will also pay the County $5,000 for the easement and right-of-way.
WHEREAS, Article IV, Section 2(k) of the Allegheny County Home rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real property.
The Council of the County of Allegheny hereby enacts as follows:
Section 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
Section 2. Authorization to permit the use of County Real Property.
County Council does hereby authorize the easement and right-of-way to Peoples Natural Gas Company on Corrigan Drive in South Park according to the terms and conditions as outlined within the Agreement. The appropriate County officers and officials are authorized to take such action as is necessary to carry out the purposes of the authorization granted herein.
