An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, directing that the detective unit of the County Police be transferred to the authority of the District Attorney.

                     WHEREAS, the Allegheny County Council is dedicated to improving the efficiency of County government and such efficiencies can be improved upon by transferring the investigative division of the County Police with the Office of the District Attorney; and

 

                     WHEREAS, the Allegheny County recognizes that duplication of services should be avoided when possible and believes that it can best be addressed by transferring the detective division of the County Police to the unit of County government that uses the product of their activity to prosecute criminals; and

 

                     WHEREAS, the Allegheny County Council finds it to be more efficient in the pursuit of criminal investigations that the investigations be supervised by the County prosecutor; and

 

                     WHEREAS, the Allegheny County Council desires to enhance government services to all residents and believes that this goal is met by reducing duplication and increasing efficiency.

 

                     The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.                     The criminal investigation functions performed by the County Police are hereby transferred to the Office of the District Attorney.  All personnel engaged in these activities are also transferred to the Office of the District Attorney.

 

SECTION                     2.                     If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION                     3.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
