A Resolution of the Council of the County of Allegheny, pursuant to the Urban Redevelopment Law of Pennsylvania, approving the redevelopment plan of the Braddock Redevelopment Area

WHEREAS, pursuant to the terms of the Urban Redevelopment Law of the Commonwealth of Pennsylvania, Act of May 24, 1945, P.L. 991, as amended, 35 P.S. Sections 1701 et. seq. (Urban Redevelopment Law), certain actions and responsibilities are required to be officially taken by the Planning Commission of the county in which a particular Redevelopment Authority operates; and
WHEREAS, in any city or county in which a planning commission does not the law permits a Redevelopment Authority to be substituted for the Planning Commission, pursuant to the Urban Redevelopment Law, 35 P.S. §1703(j); and
WHEREAS, the County of Allegheny does not have a Planning Commission to designate and certify an area to be blighted and in need of redevelopment pursuant to the provisions of the Urban Redevelopment Law; and
WHEREAS, it is therefore necessary for the Redevelopment Authority of Allegheny County to act as The Planning Commission for appropriate and necessary activities under the Urban Redevelopment Law; and
WHEREAS, the Redevelopment Authority of Allegheny County has certified an area in Braddock Borough known as the “Braddock Redevelopment Area” at its July 2001 meeting, as in need of redevelopment; and
WHEREAS, the redevelopment study has been satisfactorily performed for the area and members of the Council of the County of Allegheny has been provided with the Final Report; and
WHEREAS, the Braddock Redevelopment Area residents and property owners have been informed and consulted at public meetings with staff and agents of the Redevelopment Authority of Allegheny County on May 6, 2003, May 26, 2003, and at a duly advertised Public Hearing held jointly by the County of Allegheny and the Borough of Braddock on July 8, 2003; and
