Motion of the Council of Allegheny County pulling Bill No. 12513-22, :”[a]n ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending the Administrative Code of Allegheny County, Article 301, entitled “County Council,” §5-301.06, entitled “Prohibitions” to repeal §5-301.06.A. in order to eliminate reference to the “resign to run” requirement that formerly existed in the Home Rule Charter of Allegheny County” from committee for an immediate final vote.

WHEREAS, Bill No. 12513-22 (attached hereto) was introduced and referred to the Committee on Government Reform on November 22, 2022; and
WHEREAS, this ordinance is drafted to remove a reference to the “resign to run” requirement formerly in place within the Home Rule Charter of Allegheny County, Article III, §6(b); and
WHEREAS, on November 28, 2022, the Allegheny County Board of Elections certified that a ballot question repealing Article III, §6(b) of the Charter had been approved by the voters of Allegheny County; and
WHEREAS, because the provisions of Bill No. 12513-22 will merely render the Administrative Code consistent with the Charter (as newly amended via referendum), it is the judgment of Council that additional deliberations on the bill are both unnecessary and contrary to the clearly expressed will of the County’s residents; and
WHEREAS, the Rules of Allegheny County Council, Article IV, Section B.1.ii., allow for bills to be pulled from committee by the vote of a two-thirds (2/3) majority of the seated Members of Council if such motion is made less than sixty (60) days from the date of the first reading of the bill;
NOW THEREFORE, IT IS MOVED BY THE COUNCIL OF ALLEGHENY COUNTY,
That this Council hereby pulls Bill No. 12513-22 from the Committee on Government Reform, and authorizes an immediate final vote on the bill.
