An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania directing that an amendment to the Home Rule Charter of Allegheny County be submitted by referendum question to the registered voters of the County on the 2009 Primary Election ballot.

                                          WHEREAS, County Council believes that it is appropriate to place before the registered voters of the County the question of whether the Home Rule Charter should be amended to require that all future increases in the rate of any County tax be approved by the voters of the County through a referendum before such tax increases become effective; and

 

 

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.                                          Incorporation of the Preamble.

 

The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

 

SECTION 2.                                          Ballot Question.

 

The Allegheny County Board of Elections is directed to place the following question on the 2009 Primary Election Ballot:

 

                     Shall Article II of the Home Rule Charter of Allegheny County be amended through the creation of a new Section 4, requiring that any future increase in the rate of any tax levied by legislative action of Allegheny County be approved by the voters of the County through a referendum before such tax increase becomes effective?

 

 

 

SECTION 3.                     Severability.                        If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION 4.                     Repealer.   Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
