An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Ordinance No. 07-06, the existing schedule of facility and recreational rates and fees for the use of County recreational and park facilities.

Whereas, the County of Allegheny (hereinafter referred to as “County”) owns and operates certain recreational and park facilities; and

Whereas, the County desires to establish a new program of voluntary contributions from individuals or groups renting park facilities, in order to assist with the maintenance of those facilities; and

Whereas, Article IV, Sections 2.b. and 2.k. of the Allegheny County Home Rule Charter vests the County's Council with the power to establish fees and service charges; and

Whereas, Ordinance No. 07-06 establishes the schedule of rental rates for the County's park facilities;

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble

Section 2 of Ordinance 07-06 is hereby amended by the addition of a new Section 2.V., as follows:

V. The Department of Parks is empowered to collect an additional contribution of no less than one dollar ($1.00) from each individual, group, or other entity renting or paying a fee for using any of the park facilities delineated in this Ordinance, to be deposited into a special account for that park, provided:

1. Payment of such additional contribution is entirely voluntary, and no preference of any kind is granted to any individual, group or other entity based upon whether such contribution was made; and

2. Such additional contributions are used solely for the improvement and/or maintenance of existing park facilities, including but not limited to groves, playground equipment, pavilions, buildings or other structures, paved thoroughfares, riding trails, skating rinks and ski slopes; and
