Whereas, The White Oak Animal Safe Haven has leased a certain property owned by the County of Allegheny with the White Oak Park area,

Whereas, the White Oak Animal Safe Haven has built a animal shelter on said property,

Whereas, the White Oak Animal Safe Haven has maintained said building and been solely responsible for all expenses on said building and all insurance and required permits, licenses, etc. for said services.

Whereas, the Borough of White Oak has requested to be removed from said lease;

The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.

The provisions set forth in the preamble to this Ordinance are incorporated by reference herein in their entirety.

SECTION 2. Authorization is Granted to the County Manager to enter into Agreements for the Use of County Park Facilities.

The County Council of Allegheny County does hereby grant authority to the County Manager to continue and amend the lease agreement for the use of a certain area of White Oak Park for a no-kill animal shelter. The County Council hereby grants permission to amend the lease removing the Borough of White Oak from the original agreement and to release the Borough of White Oak from any and all responsibilities. All remaining terms and conditions remain the same.


SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall continue in full force and effect.
