Motion of the Council of Allegheny County authorizing and directing that legal counsel, acting on behalf of County Council consent to and join in the petition of the Chief Executive requesting that the Pennsylvania Supreme Court exercise and accept jurisdiction in the pending matter of James C. Roddey vs. County Council docketed in the Supreme Court at No. 11 WM 2003.

  WHEREAS, a dispute has arisen regarding the interpretation of the item veto authority of the Chief Executive, and

 

                     WHEREAS, the Chief Executive has filed a declaratory judgment action in the Court of Common Pleas of Allegheny County seeking a determination of the item veto authority of the Chief Executive; and

 

                     WHEREAS, the Chief Executive has requested that the Pennsylvania Supreme Court exercise extraordinary jurisdiction over that pending matter, and

 

                     WHEREAS, it is the sense of Council that an expedited determination of the authority of the Chief Executive's item veto authority is necessary to avoid uncertainty and confusion over the level of appropriations made to County offices and departments and the continued orderly operation of County government; and

 

                     WHEREAS, it is the sense of Council that a determination of this matter by the Pennsylvania Supreme Court will be in the best interests of the County and its citizens.

 

                     

 

NOW THEREFORE, IT IS MOVED, BY THE COUNCIL OF ALLEGHENY COUNTY,

 

that legal counsel, acting on behalf of County Council, is authorized and directed to consent to and join in the petition of the Chief Executive requesting that the Pennsylvania Supreme Court exercise and accept jurisdiction in the pending matter of James C. Roddey vs. County Council docketed in the Supreme Court at No. 11 WM 2003.
