TITLE
An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the sale of surplus and outdated weapons from the Police Academy armory located in North Park.

BODY
Whereas, the County of Allegheny currently owns surplus and outdated weapons located in the Police Academy armory in North Park; and

Whereas, the Department of Administrative Services -- Purchasing Division intends to sell such weapons to a licensed weapons dealer in coordination with an Invitation for Bid to purchase new weapons for the armory;

Whereas, the Allegheny County Police, Allegheny County Police Academy, the Department of Administrative Services -- Purchasing Division, the County Controller and the Law Department agree that the weapons are not needed by the County, and that a sale meets applicable legal requirements and should provide the optimum proceeds to County and;

Whereas, Section 701.05 of the Allegheny County Administrative Code requires the disposition of County-owned property through an Ordinance passed by County Council.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of Preamble.

The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

SECTION 2. Approval of Sale.

The County Council of Allegheny County does hereby ratify, affirm and approve the sale of surplus and outdated weapons from the Police Academy's armory in coordination with an Invitation for Bid to purchase new weapons to be used in the armory.

SECTION 3. Use of Proceeds.

All funds generated by the sale of the surplus and outdated weapons will be used to offset the cost of purchasing new weapons for the armory.

SECTION 4. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be i...
