Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, establishing a requirement that any hotel, motel, or lodging establishment must complete a mandatory background check when hiring any employee that has a job that entitles them to a room key or access to rooms within that establishment.

                                          WHEREAS, heinous crimes have occurred because of lax laws and policies involving unlawful room entry;

 

                                          WHEREAS, Allegheny County collects a hotel and motel tax and issues a health permit to said establishments; and

 

                                          WHEREAS, as a Home Rule County, Allegheny County can establish a standard registry where accumulating information concerning this industry and positions may be maintained; not to hinder any type of employment decision or autonomy of private corporations, but to maintain a central registry to safeguard the citizenry in a structural way.

 

The Council of the County of Allegheny hereby enacts as follows:

 

Section 1.                     A background check policy for hotel, motel, and lodging establishments is hereby created in Allegheny County.  Information gathered as a result of this policy shall be forwarded to the Allegheny County Police.

 

SECTION 2.                                          If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION 3.                                          Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
