Motion of the Council of Allegheny County authorizing the payment of outstanding legal fees resulting from litigation surrounding the reapportionment of County Council districts.

                     WHEREAS, members of the Allegheny County Council were sued for actions taken in pursuit of their statutory duties and responsibilities; and

 

                     WHEREAS, Allegheny County owes the Council a duty of defense when the members are acting in furtherance of their statutory duties and responsibilities; and

 

                     WHEREAS, Allegheny County Council employed the firms of Dodaro, Kennedy and Cambest; Dickie McCamey and Chilcote; and Dickstein Shapiro to represent their interests; and

 

                     WHEREAS, the litigation has been completed and all appeal rights exhausted; and

 

                     WHEREAS, Allegheny County maintained insurance coverage to address costs associated with this type of litigation; and

 

                     WHEREAS, the insurance company has been put on notice of the claims to be submitted; and the $100,000 deductible for the policy has been paid from charges made to County Council's budget; and

 

                     WHEREAS, pursuit of the claims by the County Law Department with the insurance carrier should result in the reimbursement of defense costs to the County's account.

 

NOW THEREFORE, it is moved that the outstanding legal fees which were accrued in litigation surrounding the reapportionment of County Council districts shall be paid from the County Council Contingency Reserve established in the 2003 Budget Resolution.
