TITLE
Resolution of the County of Allegheny, Commonwealth of Pennsylvania, providing for the structural location of newly-created positions, divisions, and departments following the passage of a referendum authorizing row office reform.
BODY
WHEREAS, in the Primary Election held on May 17, 2005, the voters of Allegheny County approved the “Row Office Reform” referendum that was placed before them; and

WHEREAS, the Row Office Reform referendum and the accompanying changes to the Administrative Code abolished the elected offices of Clerk of Courts, Jury Commissioner, Prothonotary and Register of Wills, and replaced them with the newly created appointed position of Director of Court Records; and

WHEREAS, the Row Office Reform referendum and the accompanying changes to the Administrative Code also abolished the elected office of Recorder of Deeds and replaced it with the newly created appointed position of Real Estate Manager; and

WHEREAS, the Row Office Reform referendum and the accompanying changes to the Administrative Code also abolished the elected office of County Coroner, and replaced it with the newly created appointed position of Medical Examiner; and

WHEREAS, the location of such positions, divisions, and departments was not specifically provided for in the Row Office Reform referendum or within the changes made to the Administrative Code.

The Council of the County of Allegheny hereby resolves as follows:

SECTION 1.

County Council shall be consulted and involved in all steps of formulating any plan for row office reform implementation, and both Council and the Chief Executive herein state their intent to work cooperatively to the fullest extent practicable in developing and employing such a plan.

SECTION 2. If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in...
