An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, establishing facility and recreational rates and fees for the use of County recreational and park facilities effective April 1, 2005.

Whereas, the County of Allegheny, Commonwealth of Pennsylvania owns and operates certain recreational and park facilities; and    
 
Whereas, the County desires to establish and revise rates and fees for the public use of the recreational and park facilities; and
 
Whereas, Article IV, Section 2.b. of the Allegheny County Home Rule Charter vests the County's Council with the power to establish fees and service charges.
 
The Council of the County of Allegheny hereby enacts as follows:
 
SECTION 1.  Incorporation of Preamble.
 
      The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
 
Section 2.  Parks Division Rates and Fees.
 
Effective April 1, 2005, the rates and fees for the use of County recreational and park facilities shall be as set forth in the Department of Parks Facility and Recreational Fees Rate Schedule - Effective April 1, 2005 - March 31, 2006, published by the Department of Parks and attached hereto as Exhibit A, the provisions of which are incorporated by reference as if fully set forth herein.  
 
 
 
Section 3.      Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in
full force and effect.
 
Section 4.      Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
