An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Part 2, Article 215, § 5-215.03 of the Administrative Code to provide that, unless otherwise required by law, all appointments to County and non-County nonprofit corporations and associations are confirmed by County Council and appointments expire at the end of the appointee's term.

                                          WHEREAS, § 5-215.03 of the Administrative Code recognizes ten County-sponsored or County-supported corporations and associations, including the Allegheny League of Municipalities, the Carnegie Library Board, the Emergency Medical Service Institute, HDCAC 202 Corporations, Human Service Center Corporation, Kane Foundation, Pittsburgh Allegheny County Thermal, Regional Trail Corporation, Southwestern PA Regional Development Council, and the Local Government Academy; and

 

                                          WHEREAS, Article 215 provides that the appointments are made by the Chief Executive without consent of County Council, yet practice reflects that some of the appointments are confirmed by Council; and

 

                                          WHEREAS, to ensure uniformity, this section should be consistent with other sections of the Administrative Code relative to appointments;

                     

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.

 

Article 215, § 5-215.03 of the Administrative Code is amended as follows:

 

§ 5-215.03.                     County and non-County nonprofit corporations and associations.

 

A.                     The following is a representative list of County-sponsored or County-supported nonprofit corporations or voluntary unincorporated associations:

 

(1)                     Allegheny League of Municipalities.

 

(2)                     Carnegie Library Board.

 

(3)                     Emergency Medical Service Institute.

 

(4)                     HDCAC 202 Corporations.

 

(5)                     Human Service Center Corporation.

 

(6)                     Kane Foundation.

 

(7)                     Pittsburgh Allegheny County Thermal.

 

(8)                     Regional Trail Corporation.

 

(9)                     Southwestern PA Regional Development Council.

 

(10)                     Local Government Academy.

 

B.                     Appointments to the board of a nonprofit corporation or voluntary association to which the County may be entitled to make shall be made by the Chief Executive with the consent of a majority of the seated members of County Council.  Such appointments shall expire at the end of the appointee's term unless otherwise provided by law.

 

C.                     Appointments subject to the term expiration provisions of this section may be extended by the Chief Executive for a maximum of 90 days beyond the date on which the appointment expires, should such extension be necessary for the orderly conduct of the business of the corporation or association.

 

SECTION                     2.                     If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION                     3.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
