An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania directing that a referendum question amending Article IV, Section 2 of the Allegheny County Home Rule Charter by adding Subsection o), pursuant to the Home Rule Charter and Optional Plans Law, be placed on the 2005 General Election ballot.

                     The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.

 

The Allegheny County Board of Elections is directed to place the following question on the 2005 General Election Ballot:

 

Shall Allegheny County's Home Rule Charter be amended to provide that the Salary Board, in the form of County Council, be reestablished only for the positions of County Officers, County Officials, Director of Court Records, Medical Examiner, and Real Estate Manager?

 

SECTION 2.

 

Upon approval of the above question, Allegheny County's Home Rule Charter shall be amended to read as follows:

 

Article IV, Section 2, o) - By resolution, approve the salaries of all County Officers, County Officials, and the salaries for the appointed positions of Director of Court Records, Medical Examiner, and Real Estate Manager.

 

SECTION                     3.                     If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION                     4.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
