An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the use of County Park Facility for a charity purpose.

                     Whereas, certain property owned by Allegheny County has been designated as Park areas, and

 

                     Whereas, these Parks areas are used for charitable and recreational purposes, as well as the presentation of special events; and

                     

                     Whereas, Article IV, Section 2.K of the Allegheny County Home rule Charter vests the County's Council with the power and duty by ordinance to lease or permit the use of land owned by the County.

 

 

The Council of the County of Allegheny hereby enacts as follows: 

 

Section 1.  Authorization is for the use of County Park Facility.

 

                     The County of Allegheny County does hereby permit the use of the County Park Facility in NORTH PARK known as Park House N-10 as a Haunted House Exhibit fundraiser.  Said haunted house is know as “Terrors by the Lake”, managed and operated by Western Pennsylvania Children's Charities (WPCC) which was created for the purpose of raising money for the Make A Wish Foundation and other charities.  Agreement between the County of Allegheny, Parks Department and WPCC is for three years - seven months, expiring December 31, 2008.

 

Section 2.  Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

Section 3.  Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
