TITLE
An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the razing of an unsafe structure in Boyce Park.
BODY
Whereas, Section 701.06 (A) of the administrative Code provides that the County may raze or demolish of any County-owned Buildings in a manner approved by Ordinances; and
Whereas, the County is the owner of a deteriorating outdoor restroom facility located near the Webelo Grove on Centerview Drive; and
Whereas, the aforementioned County property has reached an age and condition where it is a hazard and liability; and
Whereas, the Director of the Allegheny County Parks Department has requested that the building be demolished; and
Whereas, the Controller has determined that the aforementioned restroom has no value and is a liability in the present condition.
The Council of the County of Allegheny hereby enacts as follows:
Section 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
Section 2. Authorization to Raze or Demolish an outdoor restroom in Boyce Park.
A. Pursuant to Section 701.06 (A) of the Administrative Code, County Council does hereby authorize the Director of the Allegheny County Parks Department or his designee to take whatever action necessary to accomplish the demolition, razing or destruction of a restroom facility near Webelo Grove on Centerview Drive in Boyce Park.
Section 3. The County Manager or his designee is authorized to take any and all further action necessary or proper to carry out the purpose of this Ordinance.
Section 4. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
