An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of donations of personal property by the Allegheny County Park Department.

Whereas, The Home Depot Corporation has offered to donate, for use by Allegheny County Parks Department, 15,000 plans to replace some of those lost in a recent fire at the County Greenhouse; and

Whereas, the Western Pennsylvania Conservancy has offered to donate, for use by the Allegheny County Parks Department, 1,600 plants to replace some of those lost in a fire at the Allegheny County greenhouse; and

Whereas, the Allegheny County Parks Department had an unfortunate fire at the South Park greenhouse where it was growing plants for use in the parks and other County facilities; and

Whereas, the Allegheny County Parks Department recommend acceptance of said proposed personal property; and

Whereas, Article IV, Sections 2.j. of the Allegheny County Home Rule Charter vests the County Council with the power to accept personal property on behalf of the County.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

Section 2. Acceptance of Donations of Personal Property

County Council does hereby authorize the Allegheny County Parks Department on behalf of Allegheny County to accept the following donations:

A. 15,000 annuals to be donated by The Home Depot Corporation;
B. 1,600 large annuals to be donated by the Western Pennsylvania Conservancy.

Section 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
