An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Article 912 of the Administrative Code of Allegheny County, entitled "E-Verification," to ensure that labor performed pursuant to any contracts to which the County is a party or involves County property is not undertaken by individuals who lack employment authorization under federal law, as defined by 8 U.S.C. §1324a(h)(3).

Whereas, Allegheny County has traditionally endeavored to establish and employ policies and procedures designed to encourage fairness among County employees and contractors; and
 
Whereas, it is the sense of Council that no revenue derived from the payment of County taxes should go to contractors who undertake illegal employment practices that contribute to higher unemployment rates among American citizens; and
 
Whereas, it is the judgment of Council that any concept of fairness within the workforce must acknowledge the inequity inherent in employing individuals who are not within the United States legally and who, in consequence, cannot be lawfully employed; and
 
Whereas, it is accordingly the desire of Council in this time of National economic decline to ensure that public funds be spent only to employ individuals who are lawfully employed within the United States;
 
 
 
The Council of the County of Allegheny hereby enacts as follows:
 
 
 
SECTION 1  Amendment of the Code; new Section 8.
 
Division 1 of the Allegheny County Code of Ordinances, entitled "Administrative Code," Article 912, entitled "E-Verification," is hereby amended by the creation of a new Section 5-912.08, comprised as follows:
 
 
§5-912.08.      Contracts involving County land or property rights.
 
Council shall not exercise its authority under Article IV, Section 2 (k) of the Home Rule
Charter  to lease, convey, or grant permission to use County land, buildings, or other real or
personal property in relation to any contract involving services or subsidies under Section 2
or 3 of this Article or involving projects pursuant to which any work will be done on
County-owned property unless the contracting parties are in compliance with the provisions
of this Article.
 
 
SECTION 2.  Effective Date.
 
The provisions of this Ordinance shall become effective upon the date of final approval.
 
 
Section 3.      Short Title.  
 
This Ordinance shall be known as the Bernadette Turner ordinance.
 
SECTION 4.      Severability.      If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
 
 
SECTION 5.  Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
