An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending and supplementing the Administrative Code of Allegheny County, Article 301, encompassing County Council generally, through the creation of a new §5-301.07, describing the “oath of office” taken by any person holding the office of member of Allegheny County Council with additional language to support the adherence to County law.
WHEREAS, the Allegheny County Administrative Code, Article 301, provides for, among other things, the oath of office for which each member of Council must affirm; and
WHEREAS, the oath as it is currently written only requires an affirmation to adhere to the United States Constitution, Pennsylvania Constitution and the laws of the Commonwealth; and
WHEREAS, it is the belief of Council that the office of County Council encompasses not only the requirement of upholding the U.S. Constitution and state law but to also preserve, protect, defend and obey the laws of our County which are contained within the Allegheny County Home Rule Charter and the Allegheny County Code of Ordinances; and
WHEREAS, it is further the belief of Council that as a legislative body our power and duty includes the adoption of laws for the County of Allegheny and therefore Council members must necessarily be obligated to uphold what is enacted by the body and is expected to be followed by the people;
The Council of the County of Allegheny hereby enacts as follows:
Section 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their
entirety herein.
Section 2. Amendment of the Administrative Code.
The Administrative Code of Allegheny County, Article 301, entitled “County Council,” is hereby amended through the creation of a new §5-301.07, entitled “Oath of office,” and comprised as follows:
