Title: An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of a donation from the Pittsburgh Penguins Foundation and Highmark for the construction of deck hockey facilities to be located in the County’s North Park and Settlers Cabin Park.

An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of a donation from the Pittsburgh Penguins Foundation and Highmark for the construction of deck hockey facilities to be located in the County’s North Park and Settlers Cabin Park.

Whereas, the Department of Public Works and Facility Management, in conjunction with the Pittsburgh Penguins Foundation and Highmark will work together during site preparation and construction of the rinks; and

Whereas, the Agreement shall fully outline the shared duties and responsibilities; and

Whereas, Article IV, Section 2(k) of the Allegheny County Home Rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real estate property.

Whereas, Article IV, Section 2(j) of the Allegheny County Home Rule Charter vests County Council with the power and duty by ordinance to accept grants, gifts, or donations of real or personal property on behalf of the County.

The Council of the County of Allegheny hereby enacts as follows:


SECTION 1. Incorporation of the Preamble

The provisions set forth in the Preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.


SECTION 2. Authorization to accept a Donation of Real Property

County Council does hereby authorize the acceptance of said donation from the Pittsburgh Penguins Foundation and Highmark. The term of the Agreement is effective on or about April 1, 2014, with a projected completion date on or about October 31, 2015. The appropriate County officers and officials are authorized to take any and all such actions as deemed necessary to carry out the purposes of the authorization granted herein.

SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall continue in full for...
