Ordinance of the County of Allegheny granting authorization to demolish the North Park Horse Barn located on McKinney Road.
Whereas, the County of Allegheny is the owner of a building located on McKinney Road in the County’s North Park known as the North Park Horse Barn; and
Whereas, the North Park Horse Barn is in such a state of disrepair that it presents a danger of totally collapsing at any moment due to its unstable condition; and
Whereas, County’s Department of Facilities Management in conjunction with the Parks Department has concluded that the North Park Horse Barn must and should be immediately demolished because of the safety hazard that it poses to the general public; and
Whereas, Section 5-701.06 of the Allegheny County Administrative Code permits the County to raze or demolish any existing building that may be no longer necessary for the carrying out of any of its functions under terms and conditions prescribed and approved by ordinance; and
The Council of the County of Allegheny hereby enacts as follows:
Section 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
Section 2. Grant of Authority to Demolish the “North Park Horse Barn”.
County Council hereby grants authority is to demolish the North Park Horse Barn pursuant to terms and conditions and contracts recommended by the Departments of Facilities Management and Parks in conjunction with the County Law Department and approved by the County Manager. The appropriate County officers and officials are authorized to execute all agreements and documents as required to effectuate the immediate demolition of the North Park Horse Barn in order to protect the health, safety and welfare of the public and to take such other action as are deemed necessary and prudent to carry out the purposes of this Ordinance.
