An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing an Agreement to extend a lease with the Amateur Astronomers Association of Pittsburgh (AAAP), for the continued operation and maintenance of Wagman Observatory in Deer Lakes Park.
WHEREAS, on July 28, 1986, Allegheny County and the Amateur Astronomers
Association of Pittsburgh (AAAP) entered into a lease agreement for the construction, operation and maintenance of an Astronomical Observatory in Deer Lakes Park; and
WHEREAS, the Wagman Observatory has been built, maintained and operated by the AAAP under said lease and utilized and enjoyed by thousands of Allegheny County residents at no cost to the County. The AAAP will continue to offer this community program at Deer Lakes Park, provide general facility maintenance and/or pay the County $200 per year for use of said facility. The AAAP will provide all required liability insurance and fire insurance.
WHEREAS, the AAAP and the County desire to continue the lease; and
WHEREAS, Article IV, Section 2(k) of the Allegheny County Home rule Charter vests County Council with the power and duty by ordinance to authorize the lease or permit the use of County real property.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble
The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
SECTION 2. Authorization to permit the use of County Real Property
Allegheny County Council hereby approves the continuation of a contract to the Amateur Astronomers Association of Pittsburgh (AAAP) for the continued operation and maintenance of Wagman Observatory in Deer Lakes Park.
