Title

An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of a donation of materials from the Pittsburgh Penguins Foundation and Highmark, Inc. for the construction of a deck hockey rink to be located in the County’s South Park.

Body

Whereas, the Department of Public Works and Facility Management, in conjunction with the Pittsburgh Penguins Foundation and Highmark, Inc., will work together during site preparation and construction a deck hockey rink in South Park, with the Pittsburgh Penguins Foundation and Highmark, Inc. donating materials for the preparation and construction of the rink; and

Whereas, Article IV, Section 2(j) of the Allegheny County Home Rule Charter vests County Council with the power and duty by ordinance to accept grants, gifts, or donations of real or personal property on behalf of the County.


The Council of the County of Allegheny hereby enacts as follows:


SECTION 1. Incorporation of the Preamble

The provisions set forth in the Preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.


SECTION 2. Authorization to accept a Donation of Personal Property

County Council does hereby authorize the acceptance of said donation of materials to the County from the Pittsburgh Penguins Foundation and Highmark, Inc. for the purpose of construction of a deck hockey rink on County-owned property in South Park. The appropriate County officers and officials are authorized to take any and all such actions as deemed necessary to carry out the purposes of the authorization granted herein.


SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall continue in full force and effect.
