WHEREAS, §5-1203.01 of the Administrative Code of Allegheny County establishes a Government Review Commission in 2005 and every 10 years thereafter to study the Charter and County government for evaluation of the effectiveness, efficiency and equity of the County Government and Charter for the purpose of recommending amendments to the Charter;

 

                     WHEREAS, a Government Review Commission was appointed and convened in 2005 through nomination of members through the majority and minority caucuses of County Council; and 

 

                     WHEREAS, a different procedure and timeline were followed when the Council appointed individuals to serve on the Government Review Commission convened in 2015; and

 

WHEREAS, while the procedure followed in 2015 was entirely consistent with the existing provisions of §5-1203.03 of the Administrative Code of Allegheny County, which currently establishes that “Council shall select and appoint five voters of the County to serve on the Review Commission,” several Members of Council expressed concerns regarding the change in the appointment procedure, as well as the comparatively compressed timeframe on which nominations and appointments took place; and

 

                     WHEREAS, it is the desire of Council to provide additional specificity within §5-1203.03 regarding the procedure and timeline that are to apply to Council’s appointments to future Government Review Commissions;

                     

                     The Council of the County of Allegheny hereby enacts as follows:

 

Section 1.  Amendment of §5-1203.03

 

§ 5-1203.03 of the Administrative Code is hereby amended as follows:

 

 

 

§ 5-1203.03.                     Appointment of members.

 

 

A.                     At a regularly scheduled meeting of Council in February of 2005, and every 10 years thereafter, the Council shall select and appoint five voters of the County to serve on the Review Commission.  The Chief Clerk shall notify the designated majority and minority caucus chairs of the requirements of this Section no later than the last regular meeting of the year preceding any year in which voters are to be appointed by Council to serve on the Review Commission.  The majority caucus chair shall nominate three voters to serve on the Review Commission and the minority caucus chair shall nominate two voters to serve on the Review Commission, with a final vote by the full Council on all nominations to be completed no later than the second regular meeting in February of any year in which appointments to the Review Commission are to be made.  Nominations shall be deemed confirmed upon approval by a majority of the seated Members of Council.

B.                     Within 15 days after Council has formally appointed the aforesaid five members of the Review Commission, the Chief Executive shall appoint four voters of the County to serve on the Review Commission.

 

Section 2.

 

If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

Section 3.

 

Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
